Terms of Service

These Terms of Service ("Terms") govern your access to and use of Ember LMS ("Ember," "Service"), operated by Molar Labs ("we," "us"). By creating an account or using Ember, you agree to these Terms and our Privacy Policy.
If you are using Ember on behalf of a school or district, your institution's agreement with us may supplement or override portions of these Terms.
1. Who may use Ember
You must be at least 13 years old to create an account, or use Ember through a school-provided account with appropriate consent. You must provide accurate registration information and keep your credentials secure.
If you use Ember as a teacher, administrator, or staff member, you represent that you are authorized by your institution to do so.
2. Accounts & access
- You are responsible for activity under your account.
- Do not share passwords or circumvent authentication.
- We may suspend or terminate accounts that violate these Terms or pose a security risk.
- Organization administrators may manage users within their tenant according to their role permissions.
3. Acceptable use
You agree not to:
- Use Ember for unlawful, harmful, or harassing purposes
- Upload malware or attempt to access systems without authorization
- Scrape, reverse engineer, or overload the Service except as permitted by law
- Misrepresent your identity or affiliation
- Use AI features to generate content that violates school policy or applicable law
- Circumvent content safety or access controls
We may remove content or restrict access that violates these rules.
4. School & student content
Teachers and schools retain ownership of course materials, assignments, and content they upload.
Student submissions belong to the student and/or the school as governed by applicable law and institutional policy.
You grant Ember a limited license to host, process, and display content solely to provide the Service — including AI-assisted features you explicitly invoke.
5. AI-assisted features
Ember offers optional AI tools (grading assistance, tutoring, content generation). You acknowledge that:
- AI outputs may be inaccurate and require human review — especially for grades and feedback sent to students
- You are responsible for reviewing AI suggestions before sharing them with students
- We do not guarantee AI outputs meet curricular, accessibility, or legal requirements

6. Subscriptions & payment
Some features require a paid plan. If you purchase a subscription:
- Fees are billed according to the plan you select
- Taxes may apply
- Renewals continue until cancelled per your plan terms
- Refunds are handled according to your order agreement or applicable law
Free tiers may include usage limits. We may change pricing with notice before your next renewal.
7. Third-party services
Ember integrates with LMS, SIS, and identity providers at your school's direction. Your use of third-party services is subject to their terms. We are not responsible for third-party platforms outside our control.
8. Intellectual property
Ember's software, branding, and documentation are owned by Molar Labs and its licensors. These Terms do not grant you ownership of our intellectual property — only a limited right to use the Service.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Ember is an educational tool. We do not guarantee specific learning outcomes, compliance with every state regulation, or uninterrupted availability.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOLAR LABS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE IS LIMITED TO THE GREATER OF (A) AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR (B) $100 USD.
Some jurisdictions do not allow certain limitations — in those cases, our liability is limited to the fullest extent permitted by law.
11. Indemnification
You agree to indemnify and hold harmless Molar Labs from claims arising from your misuse of the Service, your content, or your violation of these Terms — except where caused by our gross negligence or willful misconduct.
12. Termination
You may stop using Ember at any time. We may suspend or terminate access if you breach these Terms, if required by law, or if we discontinue the Service with reasonable notice.
Sections that by nature should survive (liability limits, indemnification, governing law) survive termination.
13. Governing law & disputes
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles, except where mandatory local law applies.
Before filing a claim, you agree to contact us at legal@ember.edu to attempt informal resolution.
14. Changes
We may update these Terms. We will post the new version on this page and update the date above. Continued use after changes take effect constitutes acceptance. For material changes, we may require re-acceptance at login.
